General provisions
- These regulations, hereinafter referred to as the "Regulations", define the rules for using the website at www.theofferrer.com
- The owner of the website www.theofferrer.com is TheOfferrer Ltd, Registration Number: 16222238, Head Office: 86-90 Paul Street, 3 rd Floor, London, EC2A 4NE, United Kingdom.
- Contact with the owner of the portal is possible via the e-mail address: [email protected] or by post to the address of the registered office.
- These regulations are addressed to both consumers and entrepreneurs with the rights of consumers and entrepreneurs using the internet portal, unless the provisions of the regulations are addressed only to consumers and entrepreneurs with the rights of consumers or entrepreneurs.
- The condition for using the website is to read and accept the terms and conditions, privacy policy.
- The portal uses the mechanism of "cookies", which are saved by the server of the portal owner on the hard drive of the customer's end device when the customers use the portal's website. The use of "cookies" is aimed at the correct operation of the store's website on customer end devices. This mechanism does not damage the client's end device and does not change the configuration of the client's end devices or the software installed on these devices. Each customer can disable the "cookies" mechanism in the web browser of his end device. - Registration - the procedure for creating an Account on the Website
- Account - a set of data related to a given User, including information about his activity on the Website, including information provided by the User on the Website.
- Seller - a User who takes steps to sell or sells the Goods as part of the Offer
- Buyer - User undertaking activities aimed at purchasing or purchasing Goods on the Website
- Goods - goods presented by the seller via the store's website, which may be the subject of a sales contract.
- Offer - a proposal to conclude a contract for the sale of the Goods on the terms specified by the Seller, in particular containing the price and description of the offered Goods, using the Website
- Transactions - procedures for concluding and performing contracts for the sale of Goods between Users on the Website
General provisions
- The owner of the portal is not a party to transactions concluded via the Website.
- Users may be natural persons who are 18 years of age and have full legal capacity, legal persons and organizational units without legal personality, but which may acquire rights and incur obligations on their own behalf.
- During the Registration and use of the Website, the User is obliged to provide the required and true data and information and to make truthful statements.
- The User may have only one Account.
- The User is not allowed to use the Accounts of other Users and make the Account available to other persons, except for the cases of making the Account available to persons duly authorized by the User to act on his behalf.
Account registration
- A user who wants to create a customer account is obliged to register free of charge.
- Registration is made via the registration form, in which the User provides personal data necessary to set up an account.
- When filling in the registration form, the User has the opportunity to read the regulations, accepting its content by marking the appropriate field in the form.
- After submitting the registration form, the User shall immediately receive electronic confirmation of the account registration by the Website.
- The user has access to the user's account and make changes to the data provided during registration.
- The user receives access to a dedicated panel on the Website, where he can modify the entered data, as well as track the status of orders and the history of orders already completed.
- The User may terminate the account maintenance agreement at any time by sending information to the Portal Owner. The termination is effective upon its receipt by the Portal Owner. The owner of the portal may terminate the Account maintenance agreement with a 7-day notice period if the User violates the provisions or generally applicable law.
- During the registration process, the User provides the account through which he gains access to the account.
- Creating an account is not necessary to use the website.
- The User gains access to the Account on the Website after providing:
- login or e-mail address or telephone number,
- passwords
Procedure for publishing Advertisements
- The owner of the portal enables Users to publish Offers on the Website. Placing an Offer on the Website takes place after completing the advertisement publication form.
- The offer posted by the User on the Website is visible to all persons using the Website.
- Users may contact the User posting the Offer via the contact form provided with the advertisement. Depending on the User's choice, his / her telephone number may also be available to the public along with the Offer.
- Upon filling out the Advertisement publication form, the User grants the Portal Owner a non-exclusive, territorially unlimited and free license to record, reproduce and distribute all or any part of the Offer in order to display it on the Website, as well as at the Portal Owner's partners through which the promotion is carried out. Website, as well as anywhere via the Internet, including search engines (e.g. Google) and social networks (e.g. Facebook). The granting of a license is necessary for the full use of the Website. Due to the nature of the Internet, the Portal Owner does not have full control over the dissemination of content published or sent using the Website's functionality to other Users.
- The User is entitled to use the Website in accordance with its intended purpose, within the limits of the law and good manners applicable to the information society, with respect for the rights and goods of other people. In particular, the User undertakes to:
- not to take actions that could disturb the proper functioning of the Website, including not interfering with the content of the Website, Accounts or Accounts of other Users, or with IT elements of the Website;
- not to take illegal actions, including sending or publishing content that violates the law, personal rights, content containing or disseminating child pornography or terrorist content and infringing other people's intellectual property rights, as well as content of a discriminatory or racist nature, using the Website's functionality;
- not to sell goods other than fruit and vegetables and logistic services with the use of the Website's functionality (or not to take other actions having a similar effect).
- not to mislead people using the Website and the Portal Owner, e.g. by providing false information about the Lot or concealing relevant information;
- refrain from acting in bad faith, from abusing the Website's functionality, from using the Website contrary to its purpose and contrary to the Regulations.
- The content of each Offer should meet the requirements set out in point 5 above, be truthful, unambiguous and understandable. The User remains free to define the content of the Offer within the law and in compliance with the following requirements:
- the advertisement will be in English and will not contain words commonly considered vulgar or offensive.
- Indication of the final price in Polish zlotys (indicating the amount of VAT, if applicable) and possibly indicate that the price is negotiable or the Item is offered for free or the User allows the possibility of exchanging the Item for another good or service.
- the content of the Advertisement should contain a clear, accurate and complete description of the Good, including truthful and not misleading information about the features of the Item. It is forbidden to provide this information without passing the Website;
- contact details may not be indicated in the content of the Announcement, such data may be provided only in the fields of the form indicated for this purpose;
- The offer must contain information about the quantity of the offered Goods;
- The same Goods may be covered by only one Offer at a time;
- It is forbidden to include in the content of the Offer: advertising, promotional and announcement content, website addresses of the Sellers.
- The owner of the portal has the right to refuse to publish the Offer or remove the published Offer, if its content is inconsistent with the law and these Regulations.
- The owner of the portal has the right to suspend or delete the user account that persistently violates the Regulations.
- By publishing the Offer, the Seller declares that it is entitled and has the ability to conclude and perform the contract with the Buyer.
Procedure for concluding a contract between users
- By accepting the conditions presented by the Seller in the Offer, the User selects the Buy option to purchase the Goods. By performing the above activities, the User completes the appropriate form on the Offers page and confirms his choice.
- From the moment of publishing the Offer, the Seller is bound by its content. The Seller may change the content of the Offer until the User uses the Buy option. The Seller cannot effectively change its content for Buyers with whom it has concluded a sales contract under the Offer.
- The price for the Goods should be determined in accordance with generally applicable laws. The Seller, in addition to the price for the Goods, may additionally charge the Buyer only with the actual delivery costs indicated in the Offer.
- The owner of the portal is not a party to the contracts for the sale of Goods concluded between Users and does not guarantee that the Seller and the Buyer are entitled to conclude and perform the contract. Conclusion of an agreement by the User with another User whose seat or habitual place of residence is not in Poland, may result in the relevant provisions of foreign law being applicable to the Transaction.
- The Buyer enters into an agreement with the Seller by confirming the purchase using the "buy and pay" button or another with a similar meaning.
- Confirmation of the conclusion of the contract between the Buyer and the Seller is sent automatically via e-mail and is for information purposes only.
- The owner of the portal is not responsible for the behavior of Users on the Website or for improper performance or non-performance of contracts concluded as part of the Transaction, as well as for the consequences of actions taken by Users and third parties, and constituting a breach of the provisions of the Regulations. In particular, the Owner is not responsible for the quality, safety or legality of the Goods sold under the Offer, the Sellers 'ability to sell, the Buyers' solvency, and the truthfulness and reliability of the information and other content provided / transmitted by Users on the Website.
- The Seller undertakes to accept payment from Buyers for the Goods using all payment methods available on the Website for the country of the Seller's seat.
- In addition to enabling the Buyers to pay for the Goods using the services referred to in point 8 above, the Sellers may enable the Buyers to pay for the Goods also "cash on delivery" or by direct payment at the place of receipt of the Goods.
Final Provisions
- The Seller reserves the right to make changes to the regulations, in particular in the event of a change in the law. Offers published prior to the entry into force of the amendments to the regulations are implemented on the basis of the existing rules.
- The User will be informed about the change in the regulations by placing information on the home page of the online store. Users with a customer account will also receive information via e-mail.
- In the event of non-acceptance of the content of the new Regulations, the User has the right to terminate the account agreement at any time via deleting the account or submitting to the Portal Owner an appropriate statement on termination of the account agreement.

- The competent court in disputes between the website owner and the user is the court competent for the seat of the website owner.
- In matters not covered by these Regulations, the provisions of the Civil Code, the Act of November 17, 1964, the Code of Civil Procedure and the Act of May 30, 2014 - on consumer rights shall apply.
- The Regulations come into force on 09/14/2021.
